Welcome to Kaya Surfaces. These Terms & Conditions apply to the use of our website, showroom, product information, quotations, orders, and related services.
By using our website or purchasing products from Kaya Surfaces, you agree to the following terms.
1. About Kaya Surfaces
Kaya Surfaces supplies premium surface and interior materials, including quartz, quartzite, marble, granite, porcelain slabs, prefab countertops, luxury vinyl flooring, cabinetry, and related products.
We primarily serve fabricators, builders, contractors, kitchen & bath dealers, architects, designers, and other trade professionals. Our showroom is also open to homeowners who would like to view and select materials for their projects.
2. Product Information
We make every reasonable effort to present product colors, patterns, dimensions, finishes, specifications, and other information accurately.
However, actual materials may vary from photographs, samples, renderings, or images displayed online.
Natural stone is inherently unique. Variations in color, veining, texture, fissures, mineral deposits, movement, and other natural characteristics are expected and are not considered defects.
Quartz, printed quartz, porcelain, flooring, cabinetry, and other manufactured products may also have variations between production lots, slabs, planks, panels, samples, and digital images.
Whenever possible, customers are encouraged to inspect and approve the actual material before fabrication or installation.
3. Pricing & Availability
Prices and inventory availability are subject to change without notice.
Slab products displayed on our website may not show online pricing. Customers may use Request a Quote or Check Availability to obtain current pricing and inventory information.
A quotation does not guarantee product availability unless the material has been formally reserved or an order has been confirmed.
4. Quotes & Orders
Quotes are based on the information available at the time they are prepared and are valid for the period stated on the quotation.
An order becomes confirmed once any required payment or deposit has been received and Kaya Surfaces has accepted the order.
Special-order products, custom products, fabricated materials, and materials specifically ordered or reserved for a customer may be subject to additional terms and may not be cancelable or returnable.
5. Showroom & Material Selection
Our showroom is open to trade professionals and homeowners.
Customers are encouraged to view full slabs and materials in person whenever possible. Our team can assist with product selection, general product information, and availability.
For projects involving independent fabricators, contractors, designers, or installers, customers should confirm final measurements, quantities, fabrication requirements, edge details, installation requirements, and suitability with their project professional before ordering.
6. Material Holds & Reservations
Selected materials may be placed on hold when approved by Kaya Surfaces.
Hold periods and requirements may vary depending on the product, inventory level, project, and customer account.
A hold does not constitute a completed sale unless required payment arrangements have been satisfied. Kaya Surfaces reserves the right to release materials when a hold expires or agreed payment terms are not met.
7. Fabrication & Installation
Unless fabrication or installation services are specifically included in a written Kaya Surfaces quotation or agreement, the purchase of material does not include fabrication, templating, installation, plumbing, electrical work, demolition, or other project-related labor.
When a customer works with an independent fabricator, contractor, or installer, that professional is responsible for field measurements, fabrication decisions, installation methods, site conditions, and workmanship.
Kaya Surfaces is not responsible for work performed by independent third-party fabricators, contractors, installers, or other service providers.
8. Inspection of Materials
Customers, fabricators, contractors, or their authorized representatives should inspect materials before fabrication or installation.
Any concern regarding the material should be reported to Kaya Surfaces before the material is cut, fabricated, altered, or installed.
Fabrication, cutting, modification, or installation of material constitutes acceptance of the material with respect to visible characteristics and conditions that reasonably could have been identified beforehand.
9. Pickup & Delivery
Customers are responsible for providing accurate delivery information and ensuring that the receiving location can safely accept the material.
Delivery dates and times are estimates unless otherwise confirmed in writing.
Upon pickup or delivery, materials should be inspected for visible damage or discrepancies. Any visible issue should be reported promptly.
Customers arranging their own pickup or transportation are responsible for appropriate vehicles, equipment, loading arrangements, securing of materials, and transportation after the material has been released.
10. Flooring & Cabinetry
Flooring and cabinetry products may be subject to manufacturer-specific specifications, installation instructions, warranties, and care requirements.
Customers and installers are responsible for reviewing applicable installation requirements before installation begins.
Products should be inspected before installation. Installation generally constitutes acceptance of visible color, finish, style, and manufacturing characteristics.
11. Returns, Cancellations & Refunds
Returns, cancellations, exchanges, and refunds are governed by the Kaya Surfaces Refund Policy and any terms stated on the applicable quotation, invoice, sales order, or special-order agreement.
Certain materials, including special orders, custom products, fabricated materials, installed products, cut materials, and specifically reserved items, may be final sale.
12. Website Content
All website content, including product descriptions, photographs, renderings, graphics, logos, text, and other materials, is provided for general informational purposes.
Product images are intended to represent the general appearance of a material but should not be considered a substitute for viewing actual material or physical samples when precise color or pattern selection is important.
13. Intellectual Property
The Kaya Surfaces name, logo, website content, original photography, graphics, product presentation materials, and other proprietary content may not be reproduced, distributed, modified, or used for commercial purposes without prior written permission.
14. Limitation of Liability
To the extent permitted by applicable law, Kaya Surfaces is not responsible for indirect, incidental, or consequential losses arising from product selection, natural or manufacturing variation, third-party fabrication or installation, job-site conditions, improper handling, misuse, or failure to follow applicable care and installation instructions.
Nothing in these Terms & Conditions limits any rights or remedies that cannot legally be limited under applicable law.
15. Changes to These Terms
Kaya Surfaces may update these Terms & Conditions from time to time. The most current version will be posted on our website with the applicable updated date.
